PRIVACY STATEMENT


Ankle Flex, LLC, doing business as Ankle Flex (hereinafter “Ankle Flex,” we,” “us,” “our”), values your business and respects your privacy rights.  This privacy policy and Notice at Collection (the “Policy”) covers what Personally Identifiable Information (“PII”) we collect, how and why we collect it, how we use the PII we collect, the categories of third parties with whom it is shared, and the choices customers (also referred to herein as “you,” “your,” “yourself”) may have, including to access and update that PII. Please familiarize yourself with our practices and let us know if you have any questions. By using any of our sites and/or services (hereinafter collectively the “Website”), you expressly consent (where allowed by applicable law) to the practices described in this Policy, including our collection, use, disclosure, and retention of your PII as described herein, and our Terms of Use, incorporated here by reference. If you do not agree to this Policy, please do not use our Website.


WHAT INFORMATION DO WE COLLECT?


When you purchase something from our store, as part of the buying and selling process, we or affiliates we work with collect the PII you give us such as your name, shipping and billing address, payment information, phone number and/or email address in order to fulfill your order.  We or affiliates we work with may also collect any information you choose to provide us with for applicable communications regarding your order, product or service feedback, etc. When you choose to create an account with us (where applicable) or participate in other programs and promotions, you may also provide us or affiliates we work with information such as an email or physical address, phone number, birthdate, account credentials, and/or any other information that we request or collect in order to effectively administer those accounts and programs.


Information from cookies, stored temporarily as per Shopify’s Cookie policy, are also collected.  When you browse our Website, we may also receive information such as your IP address, browser type, information about your operating system, internet browsing data such as what websites, ads, or search terms referred you to our website, how you engage with our website, marketing, or communications, your transaction history, and your general location. This information helps us understand how you use our Website and gives us the feedback we need to improve them. It may also be used to enhance our ability to serve you and for analytics or marketing. We may also receive information from our affiliates to help us improve our products and services and/or assist us in marketing. Email marketing (if applicable): When you sign up to receive our e-newsletters or marketing emails, you give us permission to send you emails about our store, new products and other updates. We or affiliates we work with may collect any information you choose to provide us with (such as your name and email address) to enable us to provide you with the newsletter and/or marketing service you requested.


Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.  Therefore, Shopify’s terms of use and privacy policies apply when you browse or purchase products from our Website.  You can read Shopify’s privacy policies at https://www.shopify.com/legal/privacy.  


Ankle Flex does not intend to offer its products or services to and/or monitor natural persons in the European Union, European Economic Area, United Kingdom, or Switzerland.


COOKIE POLICY


When you visit our Website or open applicable communications with us, Ankle Flex may use cookies and other tracking technologies, including but not limited to browser cookies, pixels, beacons, website applications, and mobile application identifiers (hereinafter collectively “cookies”) to serve you. Certain of our affiliates, or third parties we or they work with, may also use cookies to collect information. By using this Website you consent, where allowed by applicable law(s), to the use of cookies (including related technologies) as set out herein. By visiting our Website and availing yourself of our services, you consent (where allowed by applicable law), to the placement of cookies (including related technologies, as defined herein) in your browser and HTML-based emails in accordance with this Policy and our Cookie Policy. You can also choose to accept or reject cookies by adjusting your cookie settings for the browser you use.


While the exact cookies can change from time to time, the applicable categories of cookies we or affiliates we work in connection with (collectively “we” or “us” for the purpose of this paragraph) may use include cookies that:


  • Are essential to the operation, functionality, legal compliance, and/or security of our Website.

  • Facilitate our business functions, including data management, diagnostics, and/or analytics.

  •  Help us recognize you across different sites and services and help us to better understand, track, and save your preferences and purchase history.

  • Help us to understand and improve your experience, to increase security, and to measure use and effectiveness of our Website, communications, and/or services.

  • Allow us to facilitate advertising, to measure or test the efficacy of advertising, and/or to provide you with advertising relevant to you.

  • Help us better understand how you access our website, your general location, and/or to distinguish between different visitors to the website.


Of note, cookies also help us know how our Website is working, but these cookies generally do not collect any PII about you.  However, you may be able to opt out of the application of some of these cookies, as discussed in the “Opt-Out” section below.


As noted above, Shopify may choose to use its own cookies to collect data. Ankle Flex is not responsible for these cookies, which may be viewed at https://www.shopify.com/legal/cookies. Shopify may also use automated decision-making to conduct risk and fraud screening.


CONSENT


When you provide us with PII to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, you imply that you consent to our collecting it and using it for that specific reason only.  


If we ask for your PII for a secondary reason, like marketing, we may either ask you directly for your expressed consent, or provide you with an opportunity to say ‘no,” according to applicable data protection laws.


WHAT DO WE DO WITH COLLECTED INFORMATION?


We use PII to provide and improve our services to you and other customers. In so doing, we anticipate using customer information in any of the following manners:


  • communicate with customers regarding Ankle Flex products and services;

  • To register and maintain an account for you, where applicable;

  • As set out in our Cookie Policy above;

  • To market Ankle Flex products and services, including through personalized advertising, products or services, and/or communications;

  • To promote and administer Ankle Flex customer programs and other activities; 

  • To help us better understand customer preferences, concerns, and trends, including through internal statistics and functions;

  • To improve customer service and support, as well as the functionality and use of our website;

  • To comply with applicable legal requirements and industry standards;

  • In other ways which are disclosed at the time you voluntarily provide such information (such as for promotions, etc.).


Please also note that several of these uses are administered by or with our affiliates and therefore may also be subject to the separate policies, terms and conditions of the applicable affiliate. This is addressed further below, including in the “Sharing of PII” and “Linked Sites and Services” sections. Ankle Flex is not responsible for any PII collected by third parties from sites or services other than Ankle Flex’s own.

SHARING OF PII


Some PII and/or other information we collect will be shared with and/or stored by affiliates as necessary for the uses specified in the use section above. As an example, we may provide some of your PII to an affiliate shipping service in order to have your item shipped to you. We may also share PII about you with third parties in the following circumstances:


  • Your PII, and the contents of all of your online communications on or through our Website may be accessed, stored, and monitored as necessary to operate our Website and perform and/or improve our services, and may be disclosed:

  • to satisfy any applicable laws or regulations,

  • to defend ourselves in litigation or a regulatory action,

  • in order to protect the rights or property of Ankle Flex and our affiliates, including to enforce our Website’s terms of use,

  • when we have a good faith belief that we are required to disclose information in response to legal process (for example, a subpoena, court order, or search warrant),

  • where we believe our Website is being used in the commission of a crime, including to report such criminal activity or to exchange information with other companies and organizations for the purposes of fraud protection and risk management.

  • We may share PII about you for any other purpose(s) disclosed to you at the time we collect your PII or with your consent. 

  • We may affiliate with other businesses to assist us in our marketing, communications, and sales efforts, and may share PII about you for these purposes. If any of those communications require us to obtain your authorization to disclose your PII, we will obtain your authorization first. You may also have the right to opt-out of applicable sharing.   • In addition, information about our users, including PII, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of insolvency, bankruptcy or receivership in which PII could be transferred to third parties as one of our business assets.


Some of this sharing may be facilitated by cookies or related technologies, which are discussed in more detail above in the Cookie Policy. Ankle Flex does not sell PII to third parties for monetary consideration. However, there may be situations in which you have the right to opt out of certain sharing of your PII. OPT-OUT


Ankle Flex does not sell its customers’ PII for monetary consideration. However, applicable law(s) may define the “sale” of PII more broadly than as an exchange for money. Where allowed by applicable law, you may be able to opt out of the applicable sale or sharing of your PII here:

DATA STORAGE AND RETENTION


We strive to retain PII only so long as is reasonably necessary to fulfill the purposes for which it is collected, including the fulfillment of purchases, customer services, warranty services, and/or our own internal statistics and functions.


Please note that your PII may be transferred outside of your jurisdiction, including to Canada and the United States. By using our Website and providing us with your personal data, you consent to these transfers in accordance with this Policy. For example, when you sign up for our e-newsletter, marketing or other notifications, your data is stored on our servers, which may be outside the United States.  We maintain your data until you unsubscribe from our email notifications. You can unsubscribe by clicking the “unsubscribe” link in our notices.  


When you purchase products through our on-line store, your data is stored through Shopify’s data storage, databases and the general Shopify application. YOUR DATA PROTECTION RIGHTS 


Depending on your location, you have certain rights regarding PII. These rights may include:


  • Right to Withdraw Consent – You have the right to withdraw previously given consent to the processing of your data.  If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your PII, at any time, by contacting us at the address below.  

  • Right to Know - You have the right to know about PII collected about you.

  • Right of Access – You have the right to ask us for copies of your PII.

  • Right to Rectify – You have the right to ask us to rectify or correct PII you think is inaccurate.  You also have the right to ask us to complete PII you think is incomplete.

  • Right to erasure – You have the right to ask us to erase your PII in certain circumstances.  However, some exceptions may apply. For example, we cannot erase your order information for 180 days, which is the window of time in which Shopify allows a customer to make a chargeback.

  • Right to restriction of processing – You have the right to ask us to restrict the processing of your PII in certain circumstances, including to limit use and disclosure of sensitive PII where applicable or to opt-out of (a) the sale or applicable sharing of your PII and/or (b) any automated decision-making or certain profiling.

  • Right to data portability – You have the right to ask that we transfer the PII you gave us to another organization, or to you, in certain circumstances.  You may request your PII by contacting us at the address under the “Questions and Contact Information” heading below.


Your rights may also include the right to non-discrimination. Ankle Flex will not discriminate against you because of your exercise of your data privacy rights.


If you would like to exercise any of these rights, or to learn more about them (including which rights are applicable in which states, such as Colorado or California), please contact (or have your authorized agent contact) us through the contact information below. 


If you make a request, we will make reasonable efforts to respond within 30 days unless required by applicable law to respond sooner. Upon receiving a data privacy rights request, and depending on which right(s) you wish to exercise, we may ask that you provide sufficient verifying information. This may be done, for example, by asking you to confirm information that you have already provided to us. If your request is denied or if you feel that your PII has not been handled appropriately according to applicable law(s), you may be able to appeal that decision. To do so, please include “APPEAL” in the subject or attention line of your email and/or written communication. For more information, contact us as set out below.


SECURITY


To protect your PII, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.


If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.


If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.


All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

It is important to remember that no system can guarantee 100% security at all times. Accordingly, we cannot guarantee the security of information stored on or transmitted to or from our services. We cannot assume responsibility or liability for unauthorized access to our servers and systems. When disclosing any PII, you should remain mindful of the fact that it is potentially accessible to the public and, consequently, can be collected and used by others without your consent. Accordingly, you should consider carefully if you want to submit sensitive information that you would not want disclosed to the public and should recognize that your use of the Internet and our Website is solely at your risk.


LINKED SITES AND SERVICES


Our Website may link to other sites or services operated by our affiliates or third parties, and may carry advertisements or offer content, functionality, newsletters or applications developed and maintained by third parties. We do not exercise control over third party sites or services. We are not responsible for the privacy practices of any such third parties. For example, you may use a third-party payment option (such as PayPal) to pay for orders. The privacy policy and practices of that third party payment provider will apply to your PII. 


Once you leave our Website via a link, enable a third-party service, or click an advertisement, you should check the applicable privacy policy of the third-party's site or service. The fact that we link to a site or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. 


We may also provide social media features on our Website that enable you to share PII with your social network(s) and to interact with our Website. Depending on the features, your use of these features may result in the collection or sharing of PII about you. We encourage you to review the privacy policies and settings on the social media site(s) with which you interact.  We are not responsible for the privacy or security of any information you share on such sites. In addition, your browser may already contain cookies placed by third-party sites. Ankle Flex is not responsible for the PII such cookies may collect or what they may do with it. Nor is Ankle Flex responsible for any PII collected by third parties’ cookies from sites other than Ankle Flex’s own.


DO NOT TRACK


We do not currently actively respond to "Do Not Track" browser signals or mechanisms that indicate a request to disable online tracking of individual users who use our Website.


AGE OF CONSENT


Our services are not directed to or intended for use by anyone under 18 years of age in compliance with the Children’s Online Privacy Protection Act (COPPA) and any other applicable data protection laws.  If you are under 18, please do not use this Website or disclose or provide any PII to us unless appropriate parental or guardian consent has been provided. If we learn that we have collected PII from a child under 18 without the proper consent, we will take steps to promptly delete the information. 


By using this Website, you represent that you are at least 18 years of age or the age of majority in your state or province of residence.  Alternatively, if you are the parent or guardian of someone under 18, you have given us your consent to allow any of your minor dependents to use this Website.


CHANGES TO THIS POLICY


We reserve the right to modify this Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Website. If we make material changes to this Policy, we will notify you here (or elsewhere if required by applicable law) that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.


If our store and/or the Website are acquired or merged with another company, your PII may be transferred to the new owners so that we may continue to sell products to you. This Policy was last updated on February 21, 2025.
